  1. Eligibility – Subject to the provisions of these Terms and Conditions, the “Parks Festival 2011” Video Competition (the “Video Competition”) organized by the National Parks Board (“NParks”) is open to all residents of Singapore. Notwithstanding the foregoing, the “Parks Festival 2011” Video Competition is not open to employees of NParks, the authorized vendor engaged for the setup of the “Parks Festival 2011” video microsite (the “Authorized Vendor) and the immediate family members of NParks employees and employees of the Authorized Vendor. NParks reserves the sole and absolute discretion to exclude or disqualify any participant and/ or submission from participating in the Video Competition.
  2. Theme – Participants of the Video Competition are required to incorporate the theme of “A Park for Everyone” in their video submissions and the videos must be filmed in parks that are managed by NParks, or, if the video is an animation, the animation must be in or of a park setting. Participants who do not comply with the theme will be deemed ineligible for the competition.
  3. Duration – The video and/ or animation submissions should be 100 seconds or less.
  4. Submission Criteria
    1. There are no limits on the number of video submissions for the Video Competition. However, all video submissions shall be uploaded on YouTube, and the official online entry form shall be submitted through the official website for the Video Competition: www.nparks.gov.sg/parksfest/video. Participants who submit incomplete entry forms will be disqualified from the competition. Video submissions uploaded on YouTube will thereafter be available for public viewing on NParks’ official website.
    2. All entry forms for the Video Competition must be received by NParks no later than 23:59 (Singapore time, GMT +8) on 21 August 2011, which is the last day of the competition. For the avoidance of doubt, entry forms will be deemed to have been received upon full transmission to NParks' web server or system host. Late, lost, misdirected, incomplete, illegible or indecipherable entry forms will not be accepted and no responsibility will be assumed by NParks whatsoever in such event.
    3. All submissions must not have been broadcasted, presented, screened or entered in any other competition, festival, or events in Singapore and/or abroad.
    4. By participating in the Video Competition, the participant warrants that:
      1. he/she is the sole legal and beneficial owner of all intellectual property rights to the video submissions submitted by him/her. In the event that any third party alleges that any such video submissions infringes the copyright or other proprietary right of such third party, the participant shall defend and indemnify NParks from and against any and all claims, loss, damages, liability and costs resulting and/ or arising therefrom.
      2. he/she has not licensed or assigned the copyright and/or any other intellectual property rights to the video submissions to any third party anywhere in the world.
    5. All video and/ or animation submissions shall not contain defamatory, violent, infringing, obscene, pornographic, sexual, indecent or unlawful material or information that violate local and international laws and regulations.
    6. NParks reserves the right to disqualify any video submissions and/ or animations that do not comply with the criteria stipulated in these Terms and Conditions or are deemed to be of poor quality or inappropriate by NParks, and such videos will be removed from NParks’ official website. False and/or deceptive entries or acts shall also render those entries ineligible.
    7. All participants in the Video Competition will be included in NParks’ database to receive monthly updates from NParks.
    8. The participant (including his or her heirs, executor and/or administrators) hereby agrees to fully defend, indemnify and hold NParks and each of the authorized vendors and the directors, officers, employees and agents thereof ("the Indemnified Parties") harmless from and against any and all claims, loss or damages (including but not limited to economic loss, damage to any property or injury to or death of any person and any legal costs) that may be suffered or incurred by any of the Indemnified Parties arising whether directly or indirectly from the creation of the video or participation in the Video Competition, including without limitation, the participant’s breach of any of these Terms and Conditions, or infringement of any copyright, property or privacy right.
    9. In no event shall NParks and the authorized vendors, and the directors, officers, employers and agents thereof, be liable for any claims, loss or damages whatsoever arising from personal injury or property damage of any nature whatsoever, any interruption or cessation of transmission whether caused by technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, traffic congestion on the internet or at any website, or any combination thereof, any bugs, viruses, trojan horses or the like which may be transmitted to or through NParks’ website by any third party, any errors or omissions in any video submissions or content, or any loss or damage of any kind incurred on the participant’s  or any other person's computer as a result of the participant’s use of any video content posted, emailed, transmitted or made available on the internet, or otherwise related to or resulting from participation in the Video Competition, except for any liability which cannot be excluded by law.
  5. Use of Material - All participants of the Video Competition hereby agree that NParks shall be granted a worldwide exclusive, royalty-free, sub-licenseable and transferable right to use, reproduce, distribute, edit or produce derivative works of display and publicize in any media format and any media channels all videos and/ or animations submitted by the participants to the competition for any purpose deems fit, including without limitation for publicity purposes and communications related to the "Parks Festival 2011" Video Competition. The above licences granted by participants are perpetual and irrevocable.
  6. Competition & Contest Winners
    1. Winning entries for the Video Competition will be decided by a panel of judges appointed by the NParks.
    2. NParks will notify all winners of the Video Competition by mail, email or telephone within one month after the closure of the Voting Contest. The names of all winners will be listed and the winning videos will be showcased on the www.nparks.gov.sg/parksfest/video website. In this regard, NParks reserves the sole and absolute discretion to post the names of the winners' and/ or showcase the winning videos on the Internet.
    3. All winners of the Video Competition hereby consent to public disclosure of their personal details submitted for the Video Competition.
    4. Prizes are to be collected as indicated in the notification to the winners. If the winners are unable to collect their prizes personally, they may authorise a third party to collect the prizes on his/ her behalf by issuing a letter of authorisation. The authorised person shall produce the original copy of the letter of authorisation and proof of identification upon request. All prizes are non-transferable, non-refundable and non-exchangeable and shall be subject to any other terms and conditions as may be imposed by NParks. NParks also reserves the right to substitute prizes where appropriate. NParks accepts no responsibility for any variation in the prize values.
    5. All ancillary costs and expenses, duties, value added taxes or tax liability incurred by the winners as a result of winning or using the prize are the sole responsibility of the winners. NParks accepts no responsibility for any taxes (such as income tax) that may arise from the winning of the prize. The participants and/or winners should seek an independent financial advice in this regard.
    6. Prizes must be collected within one month of notification.  Prize collection details will be provided in the notification. Prizes which are not collected by the due date will be forfeited and donated to a charitable organisation of NParks’ choice. No compensation will be due to a winner who fails to claim the prize within the stipulated time.
    7. The result of the Video Competition is final and binding and no appeal shall be entertained.
    8. NParks reserves the right not to award prizes for the Video Competition in any prize category if the quality of the entries does not meet NParks’ criteria, or forfeit a prize in the event that a winner is unable to satisfy these Terms and Conditions.
    9. NParks shall not be liable for any loss or damage whatsoever suffered (including, without limitation, indirect or consequential loss), or for personal injury suffered or sustained, as a result of or arising from claiming of any of the prizes, except for any liability which cannot be excluded by law.
  7. Ability to Accept Terms – Participants affirm that they are either more than 21 years of age or have sought and obtained parental or legal guardian consent, and are fully able and competent to enter into these Terms and Conditions for the “Parks Festival 2011” Video Competition, and to abide by and comply with the same. If required by NParks, participants shall submit proof of parental or legal guardian consent for their participation in the competition/contest.
  8. Variations – NParks reserves the right to vary, amend or withdraw any of the Terms and Conditions without prior notice. Any such amendments will be updated on NParks’ website accordingly.
  9. Applicable Laws – These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Singapore for every purpose.  In respect of any legal action or proceedings arising out of or in connection with these Terms and Conditions.
