CUGE Programme Terms & Conditions

In these Terms and Conditions, the following words shall have the following meanings ascribed to them:

  1. “Applicant” or “you” means the person or entity who submits the application form to attend or participate in the Course, and, in the case of an entity, shall include all employees and/or agents.
    1. Where the entity (being a firm, company, organisation or group of persons) is named as the Applicant, the representative who submits the Application shall be deemed to have the authority to bind the entity to these Terms and Conditions, and the Entity shall be considered to be jointly and severally liable for all costs and charges incurred by the Applicant and to ensure compliance with these Terms and Conditions.
    2. Where the Applicant is below 18 years of age, the Applicant confirms that he has obtained the consent of his parent or guardian to make the Application and to agree to the Terms and Conditions stated.
  2. “Application” means the application submitted by you in applying for the Course.
  3. “Course” means the course or programme selected by you as provided by CUGE.
  4. “Course Fees” means the fees payable to NParks by the Applicant for participation in the Course.
  5. “CUGE” means the Centre for Urban Greenery and Ecology, a unit of NParks.
  6. "NParks” or “we” means the National Parks Board, a statutory board constituted under the National Parks Board Act (Cap. 198A) and where the context so requires, acting as an agent of the Government of the Republic of Singapore, and shall include its officers, employees and agents authorised to act on its behalf and includes any representative or person under the direction of NParks or who is designated by NParks to act on its behalf.
  7. “Terms and Conditions” means these terms and conditions set out herein, including without limitation the General Terms and Conditions and Specific Terms and Conditions and any other terms and conditions which NParks may impose on the Applicant at any time as a condition for approving his Application.
  8. “Assessors” means the assessors and/or examiners for the Course.
  9. “Trainers” means the trainers and/or lecturers for the Course.
  10. “Participant” means the Applicant whose application has been accepted by NParks, without prejudice to the requirement for the Applicant to make payment of the Course Fees in full.

Please note that you will be entering into a legally binding contract between NParks and yourself upon the terms and conditions that follow:

  1. When you submit the Application for the Course and pay the Course Fee in full, and we accept your Application; or
  2. When you submit the Application for the Course and we accept your Application, subject always to the requirement that we receive your Course Fee in full by the date of commencement of the Course (not applicable for Government and public agencies).

Cancellation, Rescheduling or Amendment of Course
  1. NParks reserves the right to change the details of, cancel or reschedule any Course conducted by CUGE, including any change to the Trainers/Assessors, venue and the course fees if necessary or warranted by circumstances beyond our control by prior notice to the Applicant at the address / email stated in the application form.

Submission of Application
  1. Please submit your completed online Application together with full payment of the required Course Fees to CUGE at least 3 working days before the commencement date of the Course.
  2. Please ensure that your Application is complete. Your failure to submit an Application that is complete in details may render your Application liable to be rejected or may lead to a delay in the processing of your Application.
  3. Places will only be confirmed upon receipt of the duly completed application forms and payment. A reminder will be sent to you via email at least 3 working days prior to commencement of the Course.
  4. If you do not hear from us by 3 working days before the commencement of the Course, it may be because the contact information you have provided is inaccurate. Please contact CUGE at ask_cuge@nparks.gov.sg or the respective course administrator in charge.

Course Fees
  1. The full Course Fees are payable at least 3 working days before a Course commences.
  2. NParks, acting through CUGE reserves the right to reject any Application or revoke any successful Application, without any notice to the Applicant if the Course Fees due are not paid 3 working days before the commencement of the Course.
  3. Please note that if we have not received your payment in advance of the commencement of the Course, we are not obliged to admit you to the Course.

Payment

(Without upfront utilisation of SkillsFuture Credit)

Payment for Courses shall be made in full in the following manner:

  1. For all Courses/Programmes
    1. No cash and cheque payment will be accepted. Payment of course fees shall be made online via the CUGE Training Management System at https://cugetms.nparks.gov.sg by credit card / PayPal payment at the point of registration.
    2. If you have completed the Course but no Course Fees have been received by NParks, we reserve the right to take all necessary steps to recover in full the Course Fees from you, as well as any other costs or expenses incurred by NParks due to your failure in payment of the Course Fees, in which event you may also be liable for legal costs incurred.
  2. If you are utilising your SkillsFuture Credit to pay for the course upfront, please ignore this section and go to Section 5

SkillsFuture Credit

Payment for Course With upfront utilisation of SkillsFuture Credit

SkillsFuture Credit

SkillsFuture is a national movement to provide Singaporeans with the opportunities to develop skills for the future. SkillsFuture Credits aims to encourage individual ownership of skills development and lifelong learning.

Certain courses provided by NParks may be eligible for SkillsFuture Credit funding.

If you are not using SkillsFuture Credit to pay for your course or if you are not eligible to use SkillsFuture Credit, please skip this section and go to Section 4.

Offsetting course fees using SkillsFuture Credit:

  1. If you choose to offset the fees of the eligible CUGE course by using your SkillsFuture Credits. you must register for the course via the CUGE Training Management System at https://cugetms.nparks.gov.sg; The CUGE Training Management System is integrated with SkillsFuture Credit portal. You must also submit your SkillsFuture Credit application during course registration.
  2. You must submit the course registration with your SkillsFuture Credit application within sixty (60) days before the commencement date of the selected CUGE course or programme.
  3. If we have received notification that your application to utilise the SkillsFuture Credit is successful, please proceed to the CUGE Training Management System to pay for any outstanding balance course fee not paid with SkillsFuture Credit.
  4. If we have received notification that your application to use the SkillsFuture Credit is unsuccessful, or if we have not received any notification regarding your application to use the SkillsFuture Credit:
    1. You must pay the Course Fees to CUGE in full before you will be allowed to attend the Course.
    2. Should you fail to do so, NParks reserves the right to reject or cancel your registration for the Course or exclude you from participating further in the Course.
  5. If we have received notification that your application to utilise the SkillsFuture credit is successful, but subsequently informed that the approval is revoked (whether fully or partly):
    1. You must pay the Course Fees to CUGE in full or any remaining part not satisfied by the SkillsFuture Credit immediately before you are allowed to participate in the Course or continue with the Course.
    2. Should you fail to do so, NParks reserves the right to reject or cancel your registration for the Course and exclude you from participating further in the Course.
  6. If you have completed the Course but no Course Fees have been received by NParks, we reserve the right to take all necessary steps to recover in full the Course Fees from you, as well as any other costs or expenses incurred by NParks due to your failure in payment of the Course Fees, in which event you may also be liable for legal costs incurred.
  7. Please note that SkillsFuture Credit cannot be used to pay for any administration fees.

Registration and acceptance of Application
  1. Please note that registration for the Course is based on a first-come-first-served basis and payment of the Course Fees at the point of registration does not guarantee the Applicant a place in the Course.
  2. An Acknowledgement of Registration will be issued to you upon successful registration.
  3. If your registration is unsuccessful, we will inform you and the Course Fees paid shall be refunded in full to you. If you used SkillsFuture Credit to offset the whole of, or part of the Course Fees, the SkillsFuture Credit will be refunded to you.

Cancellation or withdrawal from Course by Applicant
  1. If NParks has issued you a notice stating that your Application is successful, please note that in the event that you withdraw from the Course, or do not attend the Course without valid reasons, NParks shall not refund any Course Fees paid by you (other than SkillsFuture Credits applied towards the Course Fee). To avoid doubt, the SkillsFuture credits that were applied towards payment of the Course Fees shall be refunded in the event that you withdraw from the Course or you do not attend the Course, but any balance of the Course Fees paid other than SkillsFuture Credit will not be refunded to you.
  2. However, subject to NParks’ consent and sole discretion, if you are unable to attend a course/programme with valid reasons, you may request to defer your participation in the Course to the same course scheduled for a later date (if available) or transfer your placement in a Course to a replacement participant nominated by you.
  3. Such requests must be made to CUGE either by phone, email or in writing at least 3 working days before the commencement of the scheduled Course. Any request made to CUGE less than 3 working days before the commencement of the scheduled Course will not be entertained except at CUGE’s sole discretion.
  4. For the purposes of this clause 7, “attendance” at the Course or “attending” the Course shall mean your presence at the Course as recorded by NParks, whether physically or virtually, irrespective of the time actually spent by you attending the Course.

Expected Behaviour
  1. We reserve the right to reject your Application or exclude you from further participation in a Course if there is disorderly conduct from you or any other conduct, act, or omission which may render you ineligible for the Course or which, in the opinion of NParks, renders you ineligible for the Course.
  2. In these circumstances, you will still have to pay the Course Fee in these circumstances and you will not receive a refund.

Amendments to these Terms and Conditions

NParks reserves the right to amend or modify these terms and conditions without prior notice.

Limitation of Liability
  1. NParks shall not be liable to any Applicant for any injury, loss or damage to person or property arising from delay in processing the Application and/or its rejection of the Application.
  2. NParks shall not be liable to any Applicant and/ or any Participant for any injury, loss or damage to person or property arising from or in connection with the participation in any activity, course, programme or workshop conducted by the NParks/ CUGE.
  3. Applicants and Participants are advised to take up appropriate and adequate insurance prior to the participating in the activity, course programme or workshop.
  4. This exemption clause shall take effect to the fullest extent permitted by law.

Indemnity

Without prejudice to the foregoing, the Applicant and/ or Participant shall indemnify and keep NParks fully indemnified against all demands, claims, proceedings, losses, damages, expenses, liabilities, or costs (including legal costs on a full indemnity basis) whether direct, indirect or consequential, in respect of the following:

  1. any personal injury to or death of any person (including without limitation the employees of the NParks); and
  2. damage to or loss of any kind to any property real or personal (including any property of NParks and any statutory or public authorities),

insofar as such damage or loss arises out of or in relation to any act or omission of the Applicant and/or Participant in the course of or by reason of their application for or participation in the Course organised by NParks (acting through CUGE) PROVIDED ALWAYS that the same is not due to any gross negligence or wilful default of NParks.

Contract (Rights of Third Parties) Act

For the purposes of the Contracts (Rights of Third Parties) Act, this contract is not intended to, and does not give any person who is not a party to this contract, the right to enforce any of its provisions.

Publicity and Recording

By being a Participant of the Course, you are deemed to have agreed to be filmed and recorded (by any media) during the Course. You further agree to the use of your image, likeness or any sound recording by NParks for any media or other purposes in perpetuity, which may include attendance taking for the Course, public transmission or promotional purposes, with such use being without payment and/or without claim to copyright or other intellectual property rights.

You further consent to footage including your image, likeness or any sound recording being shared with law enforcement authorities where necessary.

If you wish to withdraw your consent on the above, please inform NParks before the commencement of the Course.

Law and Jurisdiction

This contract shall be governed and construed by the law of Singapore and NParks and the Applicant agrees to submit to the jurisdiction of the courts of Singapore.
